Interest in external staffing outside of a regular employment contract remains high in hospitals. It revolves around cooperative efforts with practices, community health centers, and self-employed professionals working alone such as midwives, physical therapists, controllers or IT professionals. Compliance risks are present in all cooperative endeavors. After taking part in this seminar you will be able to identify and manage such risks.
New legal precedence concerning the risk of patients arriving at the hospital and the ability of hospital to bill for its services, as provided by partners, restricts cooperation with third parties. In this seminar, new limits will be determined and the remaining scope for design will be discussed.
The reformed status determination procedure from the clearing office of the DRV-Bund offers protection against risks under contribution and criminal labor law. The procedure has been made more flexible and has been expanded through the inclusion of so-called triangular relationships in the DRV’s audit program, as well as in the group and forecast decision-making process. These new opportunities can be used by the hospital as a way to hedge.
